TRAI had conducted an open house on Tariffs for non CAS areas etc yesterday in Kolkata. I had attended the forum which was chaired by the Chairman Mr. Mishra and Principal Advisor Mr Choubey. As a consumer I vehementally advocated for free market pricing and CAS. I suggested that if CAS is not rolled out DTH would take up the market and the local cable Tv operators would vanish the next time TRAI had suich a meeting in Kolkata. Key take aways:
 
1) The meet was attended by Pratyush Joshi, Head of STar Tv mkt and sales, representatives of WWIL, HTMT etc, Roop Sharma etc.
 
2) Almost all cable operators feared that if CAS is not mandated their viewers would shift to DTH.Once Reliance comes into the market they would seed the same with free set top boxes. Incidentally the only hurdle to a set top box is the Rs 4000 entry price. if that can be subsidized then there would be no problems at all.
 
3) When i stood up to speak I explained the problem I faced during the last cricket match when I called up my cable operator for NEO Sports for cricket and he said that those guys want Rs 50 per month. Many people like me were willing to pay up Rs 50 for a cricket match but because of this peculiar problem of some people trying to act for the majority the general consumer was deprived of something that he wanted to and could afford to pay.
 
4) Cable Tv operators are the middle men and I said that how can a middleman speak for the consumer? The money to the broadcaster is paid by the consumer and it is the middleman (cable operator) who is trying to fight for the consumer. It seemed so strange that a common rate was being put up for the whole country irrespective of what they wanted to watch and no one seemed to bother whether the customer was indeed willing to pay Rs 500 for quality broadcasts.
 
5) SOmeone in the audiance pointed out that STar charges Rs 1 in Pakistan and that there is a lot of over charging happening in india. I objected to this by saying that the DTH rates also go up to 50 dollars in some countries so we cannot compare apples to oranges.
 
6) The stress was on puting a price freeze to cable rates. In my submission  I said that putting artificial pricing barriers leads to two things
a) Lack of quality
b) Black market (Undeclaration)
We all know what happened when kerosene was sold at Rs3 in ration shops either we got adulturated koil or did not get any.
 
7) I urged the TRAI chairman to set the pricing free because certain channels like education etc cannot sustain itself on advertising revenues alone and for that a proper subscription model has to be built or else those kind of channels would never be put on air.In case some channels charged more then what the puiblic could offer then no one would opt for the channels and subscription rates would come down again.
 
8) Later on while talking to the Chairman TRAI and the Principal advisor I was informed that CAS would happen but they do not want to hasten things up. 2011 should be a "reasonable time period to look at CAS in 57 cities" is what they said but that was just a broad estimate nothing concrete because the actual notification would come in from the minister I&B.
 
9) My gut feel from the conference though was that CAS will happen but we cannot set definitive intermediate timelines for that 2011 is a good place to look at it from the terminal point of view.
 
10) The chairman TRAI and Principal advisor wanted more consumers attend the forum and said that it was nice that I attended the forum.

I also feel that CAS rollout should happen by 2011...
 
It must happen in Mumbai sooner than later where the under declaration is massive...

Exasperated by what they see as under-declaration of television subscribers by cable operators, broadcasters are contemplating independent audits in certain areas to ascertain the true number of subscribers.

When the conditional access system (CAS) was enforced in parts of New Delhi, Mumbai, and Kolkata last January, it was to have made subscriber numbers more transparent. But broadcasters believe that the reporting of incorrect numbers is still rampant. Cable operators and cable network owners, though, deny the claim.

An official at STAR India Pvt. Ltd—the Indian arm of the Hong Kong-based satellite television company wholly owned by News Corportaion—said that so far, the company had not received subscriber information from cable network owners, called multi-system operators (MSOs). “These guys are supposed to have a subscriber management system from which they’re supposed to give us data, but we’re not getting that, and we’re not getting paid. It’s quite a tricky thing,” he said, requesting anonymity.

One option for STAR, the official said, was to visit individual homes and ascertain the numbers on its own.

STAR’s problems with cable network owners have been well documented. Mintreported on 12 April that STAR had planned to take legal recourse because the company believed that MSOs were not transparent enough.

STAR is not the only one complaining. Sony Entertainment Television India Pvt. Ltd also claims to be facing the same problem. “Broadcasters are doing the audit to check whether the numbers are correct or not,” said Anuj Gandhi, president, SET Discovery Pvt. Ltd, the distribution arm of Sony and Discovery Network. “We will doing our first audit very soon,” he said.

The audit will be done to check whether the cable network owners’ data system, which records subscriber information, works properly.

The official at STAR said broadcasters and MSOs recently had a meeting in which broadcasters demanded an audit on subscriber numbers but their demand was not complied with. “It’s only talk now, but broadcasters want to make it happen,” he said.

Ashok Mansukhani, executive director, IndusInd Media and Communications Ltd (IMCL)—a subsidiary of Hinduja TMT Ltd that operates the company’s MSO business—denied that there was any confusion on declarations. “IMCL is not aware of any so-called independent audit. All CAS-related information is regularly provided to broadcasters as per the regulation,” he said.

Mansukhani said broadcasters had inspected their data, and that their transparency had not been questioned.

“We have done everything required by the law and have held joint and separate discussions with broadcasters in the presence of the Telecom Regulatory Authority of India (which also regulates the cable television business in the country) and the Indian Broadcasting Federation (the country’s apex body of broadcasters), and separately,” he said.

But there are other broadcasters for whom CAS has worked just fine. Ashish Kaul, executive vice-president, Essel Group (the promoter group for Zee Telefilms Ltd), puts STAR’s complaint down as a grouse.

The network, he believes, is reacting to the numbers because they show Zee leading STAR. “We’re not tom-tomming it too much because the sample size in the conditional access system areas is so small,” he said.

The Essel Group also runs Wire and Wireless India Ltd, one of India’s biggest cable network owners.
